Terms and conditions of purchase

Legal Compliance: The auctions are conducted in accordance with current Danish auction legislation. Auctions are held as traditional, physical hammer auctions, and therefore, there is no right of withdrawal.

Payment: The purchase price, including buyer’s premium as per the price list, must be paid in full to Svendborg Auctions, either at the time of the sale or upon request. Payment is due in cash unless another agreement has been made prior to the auction. If using Invaluable.com, an additional 5% is added to the hammer price.

Condition of Items: The items sold are received by the highest bidder in the condition they are in at the time of the hammer strike and are the buyer’s responsibility from that moment onwards. Purchased items must be collected no later than 8 working days after the auction ends. After 14 days, a storage fee will be charged according to the price list. Catalog descriptions are made to the best of our knowledge.

Disclaimer: We reserve the right for errors in weight, measurements, names, and age descriptions. Damages are not indicated in the catalog. If the purchased item is found to be a forgery and satisfactory proof is provided, the buyer is entitled to return the item in the same condition within 14 days.

Bidding Disputes: Disputes regarding the highest bid will be resolved by re-auctioning the item. The minimum bid and increments are at the discretion of the auctioneer.

Liability: Anyone purchasing on behalf of another is personally liable as a guarantor. If multiple people buy together, they are jointly and severally liable. Those who vouch for others are liable as guarantors.

Obligations: Any bidder is obligated to pay immediately upon request during or after the auction, provide the requested security, or hand over the purchased items. In the latter case, the bidder is liable for any loss incurred by resale at auction, without claim to any potential surplus. The buyer does not acquire ownership of the items until the purchase price is fully paid.

Late Payment: If payment is not made by the due date, the collector is entitled to seize assets from the debtor to cover the auction amount plus interest at 2% per month from the due date until payment is made, along with the costs of the seizure process, including fees for the requisition. If the collector prefers legal action, the debtor, whether buyer or guarantor, is obliged to submit to a judgment for payment of the auction amount with interest and costs.

Artist Royalty Fee to VISDA: According to the Danish Copyright Act §38, a resale royalty of 5% on the hammer price plus auction fees of 25% must be charged on works by all recent Danish and certain foreign artists. These works are marked with "CD" (for Copydan) next to the catalog number. The resale royalty is collected by Svendborg Auctions on behalf of the rights holders' collective organization Copydan for the artworks covered by the law. No Copydan fee is required if the individual artwork costs less than DKK 2,235 at the hammer price (excluding VAT, but including premium).

Sales Conditions for Lost and Found Items from Fyns Police
All items are sold as seen. No guarantees are provided regarding condition and functionality. For bicycles, keys and chargers may be missing. The invoice should be kept for future reference.
